General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded via the Strategify website (hereinafter “we”, “us”). By purchasing a service on our website, customers (hereinafter “Customer”) agree to these GTC.

2. EU AI Act: Declaration on the use of Artificial Intelligence “AI” at Strategify

At Strategify.ch, we use modern AI technologies such as Perplexity, Claude, ChatGPT, CoPilot, or other GenAI tools to assist you in creating your application documents. In this process, the AI serves merely as a tool to provide you with an additional perspective (“Second Opinion”).
Important: You make all decisions regarding your application documents yourself. The AI does not make automated decisions but helps to draft your documents professionally. We recommend that you carefully review the results and adapt them to your needs. This way, you always remain in control!

3. Subject Matter of the Contract and Description of Services

Strategify offers intangible services provided on the basis of information made available to us by customers.

Our services include, among others, consulting and analysis services specifically tailored to the needs of the customers.

The descriptions of the individual services on our website are binding, subject to any changes or errors.

4. Conclusion of Contract

By clicking the “Buy” button in the webshop, the Customer submits a binding offer to conclude a purchase contract.
The contract is only concluded upon our written confirmation via email or by the provision of the service.

5. Terms of Payment

All services must be paid for in advance. Receipt of payment is a prerequisite for the provision of the agreed service.

Payment can be made using the payment methods specified on our website.
After successful payment, the Customer will receive a confirmation via email.

6. Customer’s Obligations to Provide Information

The Customer undertakes to provide us with all necessary information required for the provision of the service.

Strategify reserves the right to begin the service only after receiving all required information and after its review.

The Customer guarantees that the information provided is correct and complete. Incomplete or incorrect information may lead to delays or the termination of the service.

7. Handling of Information and Data Protection

Strategify undertakes to treat the information provided by the Customer with care and confidentiality. The information will be used exclusively for the purpose of providing the commissioned services.

Strategify explicitly undertakes not to use the information of customers for its own projects or to exploit it in any other way, unless the Customer has given express written consent.
All information is subject to our privacy policy and will be processed in accordance with applicable data protection laws.

We take appropriate technical and organizational measures to ensure the protection of information and to safeguard it from unauthorized access.

8. Liability

To the extent permitted by applicable law, neither Strategify nor its partners, shareholders, consultants, employees, affiliates, or other representatives shall be liable for any loss or damage arising out of or in connection with the use of the materials or the facilities or services offered through this website (including, but not limited to, indirect or consequential loss, loss of data, income, profit, or opportunity, loss of or damage to property, and claims of third parties), even if Strategify has been advised of the possibility of such loss or damage or if such loss or damage was reasonably foreseeable.

When providing information, the Customer bears the responsibility for the accuracy and completeness of the details. Strategify assumes no liability for damages resulting from incomplete or incorrect information provided by the Customer.

Strategify is not liable for lost profits or non-material damages.

9. Warranty and Complaints

Strategify warrants that the services will be provided in accordance with the contractual agreements and with due care.

Should defects in the service provided be identified, the Customer must report this in writing within 14 days of receiving the service.

Strategify will, if justified, either remedy the defects or offer an appropriate replacement of the service. Further claims are excluded.

10. Cancellation Policy

Consulting: If the client terminates a consulting project prematurely, all expenses incurred up to that point plus 50% of the expenses not incurred according to the assignment are due.

Coaching: Following a non-binding and free initial consultation, the amounts due in the offer must be paid upon the start of the coaching program, even if the program is terminated prematurely. The program and/or coaching may be interrupted for health reasons or due to prolonged absences, but for a maximum of 3 months.

Individual Coaching: Following a non-binding and free initial consultation, appointments for individual coaching sessions are planned individually. The agreed costs are incurred for coaching sessions conducted. Cancellations within 24 hours will be invoiced at 50%.

Training: For cancellations later than 45 days before the training date, 50% of the seminar price will be charged; for cancellations later than 30 days before the start of the event, the full seminar price will be charged. In the absence of a written cancellation, the full seminar price becomes due.

Expenses and Third-Party Costs: Travel expenses based on actual costs (1st class rail or car at CHF 0.85/km), meals/accommodation based on actual costs. Costs for third-party services such as hotels, translations, and production of aids will be borne or invoiced to the client, unless otherwise agreed.

11. Right of Withdrawal

As these are intangible services created individually for the Customer, there is no statutory right of withdrawal after the service has been provided.

12. Severability Clause

Should these regulations or parts of these regulations be or become invalid, the validity of the remaining regulations shall not be affected. The invalid regulation shall be replaced by a regulation that comes closest to its economic purpose.

13. Applicable Law and Jurisdiction

The GTC of Strategify are subject to Swiss law. The place of jurisdiction for all disputes arising from or in connection with these GTC is Aarau, Switzerland.
